Public Land Use Notices

Below are notices and announcements for active land use permit applications, code amendments, comprehensive plan amendments, and environmental reviews. The application review process includes opportunities for public comment and, in some instances, appeal.

As part of the land use permit review process, community members are invited to comment on the proposal. For most permit processes with a formal comment period, property owners and occupants within 300 feet of a proposal are sent a notice in the mail. Other types of public notice may include posting at official locations such as City Hall, publication in the Everett Herald, and a public notice sign at the subject property.

All comments must be submitted in writing to the Project Planner by the end of the comment period. People who provide input typically become a Party of Record, and receive future notifications associated with that land use permit.

Notice of Application: Ascend Buffet (PDR-24-0006)

Date of this Notice: December 31, 2024

Description: On December 20, 2024, Ascend Buffet completed their application for a proposed restaurant within the existing building on a 3.2-acre site zoned General Commercial (CG). The current building totals 28,886 square feet, of which 22,954 square feet will be used for restaurant space while the rest will be used for storage. There are no proposed changes to the exterior of the structure, nor is the square footage of the structure changing. The roof cover structures on the south side of the building are proposed to be demolished and replaced with 87 parking stalls for a site total of 230 parking stalls.

Description: On November 13, 2024, Matt Driscoll, on behalf of Aurora Rents, completed an application for a proposed one-story retail building with an adjacent storage building with building square footage on site totaling 11,824 square feet. Proposed construction improvements to the 1.53-acre site include all associated utilities, stormwater management, right-of-way improvements, parking, and landscaping.

Decision: On December 19, 2024, the City of Lynnwood’s Mayor granted preliminary approval for a Short Plat for one parcel to be divided into two separate lots for a property located at 3212 172nd St SW in Lynnwood. Proposed Lot 1 will contain 11,729 sq. ft. and an existing house. Lot 2 will contain 9,665 sq. ft. The property is zoned RS-8. NOTICE IS HEREBY GIVEN that the City of Lynnwood SEPA Responsible Official has issued a Determination of Non-significance (DNS) for the following proposal:

City of Lynnwood Code Amendment: STEP Housing Update (CAM-24-0003)

Project Description: On November 20, 2024, the City of Lynnwood Development & Business Services Department, on behalf of the City of Lynnwood, submitted a SEPA checklist for the incorporation of HB 1220 (2021) into Title 21 of the Lynnwood Municipal Code, which requires jurisdictions to update their development regulations with respect to “STEP Housing”, which encompasses emergency shelters, transitional housing, emergency housing, and permanent supportive housing.

Comments and Appeals: This DNS is issued under WAC 197-11-340 (2)(c); as the lead agency, City of Lynnwood will not act on this proposal for 14 days from the date of issuance. The comment period ends December 6, 2024, and the DNS will become final unless the determination is withdrawn or amended by the City’s SEPA Responsible Official.

Any aggrieved person may appeal this threshold determination by submitting an appeal in writing to: Development & Business Services, 20816 44th Ave W, Suite 230, Lynnwood, WA 98036. An appeal may be submitted only after the close of the comment period but no later than December 20, 2024, which is 14 days from the end of the comment period. SEPA Determination: Mitigation Determination of Nonsignificance (MDNS) for the City of Lynnwood Comprehensive Plan 2024 Periodic Update (Non-Project Action) (SEPA-24-0006)

Notice is hereby given that the City of Lynnwood SEPA Responsible Official has issued a Mitigated Determination of Nonsignificance (MDNS) for the City of Lynnwood Comprehensive Plan 2024 Periodic Update (Non-Project Action)(SEPA-24-0006).

Project Description:

The City of Lynnwood is proposing amendments to the Lynnwood Comprehensive Plan to fulfill the Growth Management Act (GMA) requirements under RCW 36.70A to periodically conduct a thorough review of the Comprehensive Plan and related development regulations. The proposed amendments are scheduled to be adopted prior to December 31, 2024. The amendments under consideration:

1. Bring the Comprehensive Plan up to date with relevant changes to the GMA;

2. Respond to changes in land use and population growth including planning for housing affordability; and

3. Address incremental change in the community since the 2015 Comprehensive Plan.

The Comprehensive Plan elements have been updated to reflect current city and state priorities.  Goals and policies have been added and edited for clarity and readability. Policy language has been reviewed for consistency with the GMA, VISION 2050, and the Countywide Planning Policies for Snohomish County. The draft Comprehensive Plan references and includes land use capacity to accommodate the 2044 population and employment growth targets mandated by the Countywide Planning Policies.

An environmental impact statement was prepared (EIS) was prepared and issued for the City’s initial Comprehensive Plan (1994), and a supplemental EIS was prepared and issued for the periodic update in 2001. Threshold determinations were issued for the annual amendments to the Comprehensive Plan. Additional environmental review will be conducted separately from the Comprehensive Plan under the City Center + Alderwood Subarea Plan. This includes a planned action EIS to determine project specific mitigation measures necessary.

Mitigation Measures:

The City Center + Alderwood Subarea Environmental Impact Statement will be completed prior to development regulation updates scheduled for May 2025. This mitigation measure will coincide with zoning update requirements set by ESSHB 1110 addressing Minimum Development Densities in Residential Zones, EHB 1337 addressing Accessory Dwelling Units – Urban Growth Areas. 

Comments: This MDNS is issued under WAC 197-11-350; as the lead agency, City of Lynnwood will not act on this proposal for 14 days from the date of issuance. The comment period ends September 27, 2024, and this MDNS will become final unless the determination is withdrawn or amended by the City’s SEPA Responsible Official.

NOTICE OF CITY COUNCIL HEARING: 2023 City of Lynnwood Comprehensive Plan Proposed Amendment List (PAL)

The Lynnwood City Council will conduct a public hearing at which the below-referenced project will be considered. Interested community members are invited to attend this public hearing and to provide comments, either orally or in writing.

Project Description: The 2023 Comprehensive Plan Amendment Proposed Amendment List (PAL) is commonly referred to as the docket. The 2023 PAL contains one proposal for consideration by the City Council. Final decisions on the proposed amendments will be made by the City Council in Fall 2023.

HASCO-Future Land Use (FLU) Map Comprehensive Plan Amendment and Concurrent Rezone (RZN-010060-2023): Housing Authority of Snohomish County (HASCO) submitted an application to revise the future land use designation for 5710 & 5714 200th St SW, owned by HASCO, from Medium-density Multi-family (MF-2) to High-density Multi-family (MF-3) and a concurrent rezone from Medium-density Multi-family (RMM) to High-density Multi-family (RMH).

A City Council work session briefing regarding the 2023 Comprehensive Plan Amendment Proposed Amendment List was held May 15, 2023.

The Lynnwood City Council will conduct a public hearing on June 12, 2023. At the time and place stated below, all interested parties will be heard. All interested persons are invited to offer any comments they may have regarding the proposal. No new materials, testimony, or statements shall be considered by the City Council after the date of this public hearing.

Per RCW 36.70A.130, the City of Lynnwood is required to periodically update its comprehensive plan and development regulations. The last major Comprehensive Plan update the City completed was in 2015, with minor amendments occurring annually.

2023 Annual Amendment Process

By state law, amendments to the Plan generally may be considered only once a year. The deadline for filing for the 2023 amendment cycle is March 31, 2023.

Proposal: Appeal of Mitigated Determination of Non-Significance Lynnwood Comprehensive Plan – Imagine Lynnwood, (APPL-24-0001).

Notice: The City of Lynnwood’s Hearing Examiner will conduct an appeal hearing on December 5, 2024, at 9:00 AM. All interested parties will be heard. The appellant has the right to call witnesses and present evidence; however, all interested persons are invited to be present and to offer any comments they may have regarding the proposal. No new materials, testimony, or statements shall be considered by the Hearing Examiner after the date of this public hearing.

Project/File Number: Mitigated Determination of Non-Significance Lynnwood Comprehensive Plan – Imagine Lynnwood (SEPA-24-0006)

Project Proposal: On October 9, 2024, the Appellant, Theodore R, Hikel Jr. submitted an appeal to the Mitigated Determination of Non-Significance for the Lynnwood Comprehensive Plan – Imagine Lynnwood (SEPA-24-0006).

Circumstances of Appeal: On September 13, 2024, the City of Lynnwood issued a determination that the proposal (SEPA-24-0006) will not have a probable significant adverse impact(s) on the environment. A mitigation measure was added to the city-wide determination for completion of the City Center + Alderwood Subarea Planned Action Environmental Impact Statement. This mitigation measure will coincide with zoning update requirements set forth by ESSHB 1110 addressing Minimum Development Densities in Residential Zones, and EHB 1337 addressing Accessory Dwelling Units – Urban Growth Areas.

The following provision(s) of the Lynnwood Municipal Code which are the subject of the appeal:

Statement of Appeal: The Appellant states ““The City of Lynnwood Comprehensive Plan 2024 Periodic Update (SEPA-24-0006)”, has not been available to the public or the City Council in a finished form as far as I have been able to determine. At a September meeting the Council requested changes to the document presented to them at that time. I have not seen an update as requested by the Council. I hereby appeal the threshold determination.” Appellant also states that property rights will not be protected, and that the SEPA determination did not evaluate impacts on personal and financial wellbeing.

Appeal of Hearing Examiner Decision: Only the appellant or the applicable department director may request reconsideration by the Hearing Examiner or appeal the Hearing Examiner’s decision to Superior Court. The request for reconsideration must be filed within seven (7) calendar days of the date of the Hearing Examiner’s decision and does not alter the appeal period for filing with Superior Court unless the reconsideration request is granted. An appeal to Superior Court must be filed within twenty-one (21) days from the date of the Hearing Examiner’s decision is issued. The date of issue is three days after mailing.

Martinez Duplex Variance (File No. VAR-24-0002) 

Notice: The City of Lynnwood’s Hearing Examiner will conduct a public hearing on November 12, 2024, at 10:00 AM, at which the project described below will be considered. Interested community members are invited to attend this public hearing and to provide comments, either orally or in writing.

Description: On July 23, 2024, the applicant, ‘Upstate Engineering’ completed their application for a Variance to provide flexibility from the Lynnwood Municipal Code’s limitations on front, side, and rear setbacks for a proposed expansion of an existing Duplex. The proposed expansion includes adding one story to the existing one-story Duplex, along with related building improvements. The site is zoned RMM. The application is subject to Process I of Chapter 1.35 LMC. A decision will be made by the Hearing Examiner following the public hearing.

Description: On May 6, 2024, Latino Educational Training Institute (LETI) completed their application for a proposed 20 child (4 infants, 6 toddlers, and 10 preschoolers) daycare facility within an existing building. Proposed construction improvements to the 0.23-acre site include the addition of an outdoor play area for up to 10 children. The application is subject to Process I of Chapter 1.35 LMC. A decision will be made by the Hearing Examiner following a public hearing.
